A taxing dilemma... Just the tip of the numerical iceberg


Have you ever been fabric shopping in the district, and been (a) happily surprised or (b) disappointed that sales tax has or has not been added to your purchase?

Well, I spent some time on the phone with the New York State Sales Tax Information hotline this morning to get to the bottom of this very issue.  I needed to make sure I understood it for myself.



Are you sewing for yourself or doing this non-professionally?

There is no sales tax applied if the fabric or notions you are buying are components of an item(s) you will sell for less than $110, OR WILL NOT OFFER FOR SALE AT ALL.  The reason I have highlighted NOT OFFER FOR SALE AT ALL, is because making something for yourself or as a gift - therefore NO SELLING PRICE, will not be taxed, regardless of the amount of your fabric/notions purchase. Does the IRS care if you make something WORTH $1000 if you don't sell it at all? Nope. No sales tax. Boom.

Now, there are some "catches" to learn about. And they can get wildly confusing.  For example: What you buy in the fabric store has to become part of the item.  Is that seam ripper part of the item? Not unless you sew it on!

Now look at this paragraph, and see if you don't get a headache:


Clothing, footwear, and items used to make or repair exempt clothing sold for less than $110 per item or pair are exempt from the New York State 4% sales tax, the local tax in those localities that provide the exemption, and the ⅜% Metropolitan Commuter Transportation District (MCTD) tax within the exempt localities in the MCTD. The MCTD consists of the city of New York and the counties of Dutchess, Nassau, Orange, Putnam, Rockland, Suffolk, and Westchester. The exemption applies only to clothing and footwear worn by humans. It also applies to most fabric, thread, yarn, buttons, snaps, hooks, zippers, and similar items that become a physical component part of exempt clothing, or that are used to make or repair exempt clothing. The following are not eligible for exemption: • Clothing and footwear that sold for $110 or more per item or pair. • Costumes or rented formal wear. • Items made from pearls, precious or semi-precious stones, jewels, or metals, or imitations thereof, that are used to make or repair clothing eligible for exemption. • Athletic equipment. • Protective devices, such as motorcycle helmets.
Also from the same NY government website:


There is no sales tax on an item of clothing or footwear that costs less than $110. An item of clothing or footwear that costs $110 or more is subject to the full 8.875% tax rate. Sales tax is calculated per item, so even if you buy two or more items that add up to $110 or more, you only pay tax on the items that individually cost $110 or more.

The following purchases are exempt from sales tax (longer list on the site):

  • Medical equipment and supplies for home use
  • Prosthetic aids and devices, hearing aids, and eyeglasses
  • Laundry and dry cleaning services
  • Shoe repair services
  • Some items used to make or repair clothing and footwear

If you are having your fabric and/or notions shipped to another state or country, there are even more complications, rules, and fees to consider.  Those things, I'm afraid, you will need to research yourself...

I've looked through my own receipts from the garment district myself.  The only thing I've discovered, is that the vendors in the district tend to be consistent with their own policies.  Either they tax EVERYTHING or tax NOTHING. 

My advice?

Basically, learn and know the rules for your own situation if you want to be properly charged...

A holiday Speakeasy

In response to a particular tourist request, I will lead a holiday Speakeasy on Friday January 2, 2015.  All usual Speakeasy rules and itinerary information will apply:


Itinerary:


10AM - 1PM - 

Shopping (Will include a specifically selected set of stores with a wide variety of offerings suitable for many different purposes/types of garments, appropriate for the theme of the day's tour. Relevant additional information, suggested additional resources and appropriate on-site expertise will be available.)

1PM-2PM

Lunch (local restaurant reservation for our group, already included in your fee.)

2PM - until end of business day

Armed with your "Secret Map" and your own interest in or desire to visit the many other stores you see or have learned about, you may visit more garment district stores if you wish, and give unique codes (that you'll get from me) to vendors who will give special assistance/discounts.

The cost of this guided, efficient tour is $75 per person. If you use this trip to shop and participate in what the NYC garment district has to offer, you will save at least as much as you are paying in supplies and education, and probably far more.

From outta town? If you need hotel and/or travel help, I will advise some of the BEST NYC secrets I know! Payment is only accepted via PayPal (you do not need a Paypal account), credit or debit card. No cash, personal checks, or additional payments will be accepted on the day of the tour. The trip will involve a good amount of walking, so come prepared in weather-appropriate gear, and healthy.

Regarding cancellations:

 If you have paid and wish to cancel 7 days or more before date - 100% refund
 Fewer than 7 days - 50% refund
 If you don't come on the scheduled date or cancel within 24 hours or less - you will forfeit your refund, but can switch reservation to a future tour date.
 If I cancel a tour for reasons not related to weather, newsworthy acts of God or other emergencies, you are entitled to your choice of a full refund, or a future tour.

October 17 Speakeasy tour

Another general shopping Speakeasy tour is scheduled for October 17, 2014.  This is by far, the time of year when most people are interested in doing a Speakeasy tour!  If asked, I/we will do custom tours before that date.

Itinerary below:

 A group reservation for lunch at 1PM will be made, and is optional for anyone who wishes to join (note the "with" or "without" lunch prices). If you decline lunch at this time, it is still your option to come along with us, but you will be responsible for your own lunch bill.

Custom garment district tour, and an Australian girl's dream achieved!

I am often amazed at how far the tentacles of this little blog can stretch.

Some months ago, a wonderful Australian woman came to visit New York City, booked a quick custom tour with me, and together, we found the perfect fabric, supplies, and notions to create this beautiful dress for her daughter's school ball (like an American prom) gown.

Funny enough, the Australian fell in love with this particular fabric (slightly different from what she chose for her daughter), and bought what became the under-layer for herself, but, upon her return to Australia, her daughter LOVED it, so I went to the garment district to procure a matching chiffon layer for this dreamy silk, and sent it to her in Australia!

*Note: The dressmaker commissioned to make this gown is in Australia, and she did a stellar job!

If you didn't know it already, this effort proves that a mother's love is boundless! What a lucky girl!

Sometimes you have to walk away... Sometimes you need help... Sometimes you have to know what questions to ask before you can find the answers...

Glorious woolens - I'll show you where! (Or you may already know...)


This post was inspired by a recent private tour I did with a client.  I love to help people navigate and shop the garment district, and often help to teach them the garment district culture, so they know how to operate to get what they need.  Since the readers of this blog are both shoppers and proprietors of businesses in the district, I cannot share some some of the specifics with you here (I'd have to whisper... and you're not within earshot), but here is some food for thought. Some of you know many of these answers already, and believe me, it would be nothing but helpful for you to comment publicly below if you are so inclined... but I will also comment when I feel an answer is specifically incorrect and/or incomplete.

So... let's say...

You've found a great fabric for your project.  You need 3 and 1/2 yards of it.  When the sales assistant unrolls the fabric, you see that there are three full yards, and a 3/4 yard piece of it, perhaps with a jagged swatch cut from one corner.  Do you buy it anyway?  How much of it do you buy? What should the vendor offer you (if anything) as an incentive for you to buy it?  What factors do you need to consider?  What question(s) should you ask?

You see a fabric you love, and you are thinking of buying it.  You ask for the price.  The vendor asks how much you want to buy.  What is your answer?

You see a fabric you want to buy.  You ask for the price.  The vendor hesitates, and then gives a number.  What question do you ask next?  How would you get a sense if the price quoted is fair?

You are thinking of starting a line, or producing something in significant quantity.  You want to find the right vendors for your supplies.  Where should you start?  Do you go to your favorite fabric store? Do you go to the Fashion Kiosk? Why, or why not?

You want a reversible invisible zipper.  Does it exist?
You want a two way invisible zipper.  Does that exist?
You need bra cups for an evening gown.  You are between a C and a D cup.  Do you buy the cup that may be a bit too large, or a bit too small?  Why?

You need buttonholes made.  How do you mark them?  Is there a correct method to get the results you need?  What are your options?

Where can I get handbag hardware?  Once I get it, will I be able to actually make a bag on my own?

Why aren't the answers to these questions listed above?

This marks 31 years that I've been shopping in the district  - and yes, I've been sewing and shopping here since I was a child (not joking), and I've learned a great deal.  It is my goal to help you learn a great deal, too! Elliott Berman Textiles...

Buckle your seatbelts, folks...  

On my birthday, after attending the David Kelley Talk, I hopped over to the garment district to curate the goods available in the stores I wanted to recommend to my Speakeasy participants.  With the wonderful assistance of Eugenia (below), I found beautiful things at Elliott Berman Textiles. (I was also wearing one of my favorite tops that day!)




I looked at all they had to offer, as their beautiful selection of fabrics grows, and I found some truly exciting things!  Among them, a new collection of organic scarves.  Yes, you heard me correctly - scarves - you can simply wear them just as they are (and they are breathtaking), or you can use them as border yardage on other projects.  A perfect way to make a border for a skirt, tunic, or home dec project, these jacquard weaves are quite elegant, and unusual in color combinations and textures. This is a collection you need to see in person to truly appreciate.

The prevailing themes at E.B. right now are double-faced fabrics, really exciting COLORS and prints, and rich textures.  The wools are out of this world (don't wait until Fall to buy them), and the knits are wildly exciting, too.  Go see them. The quality and resilience of their knits is particularly stellar.

So... there's this black and white basketweave (above) that just sings when seen in a wide expanse or yardage.

Double faced knit

This double faced knit came home with me...

Inspired by this photo (below - can you picture it?) - a contradiction of a casual shirt - using the reverse as a tuxedo-like "dickie" on a very plain shape. i'll have to show the finished product for you to see what I mean, I think...






blah blah blah - who cares?  Again, no words do them justice - just Look at these pictures!

This (above) could be a two-tone reversible denim jacket for Fall - (I have a unique design idea for reversible pockets in mind for this one) with flat-fell seaming, to make it all flow.

Basic idea,  a masculine looking men's jacket, but for  for me... a woman!

So, all in all, found some great things at Elliott Berman, and I suggest you go there, too!  They are open Monday through Friday only, and are located in an office building.  Take the elevator to the 7th floor and go to your right.  Read this primer before your visit, because the setup is unusual, and it is best to be prepared...
